HEALTH AND SAFETY
Upgrade of outdated tobacco law on the way at last A bill seeking to tighten SA’s antismoking legislation and to regulate e-cigarettes is expected to be submitted to parliament before the end of the year. The Control of Tobacco Products and Electronic Delivery Systems Bill has been in the pipeline since 2018 and has been staunchly opposed by the tobacco and e-cigarette industries. The government’s failure to process the bill has frustrated public health experts, who say SA has fallen behind global best practice. The 2008 Tobacco Products Control Amendment Act now in force has not been updated in more than a decade and has no measures for regulating new-generation products such as vapes. |

Landmark ruling confirms ARB can make decisions on non-members’ advertising The Supreme Court of Appeal’s ruling that ARB can consider the advertising of members and non-members alike is a win for consumer protection. The court confirmed that the Advertising Regulatory Board is entitled to consider the advertising of non-members, and issue decisions on adverts created by agencies and brands that don’t belong to the industry body, for the guidance of its members.

Massive change for passports in South Africa Minister of Home Affairs Aaron Motsoaledi says that the flexibility afforded to passport applications and collections in South Africa is being removed to protect the integrity of the document. The change follows high-profile cases of fraud and corruption involving passports in recent months, which have damaged the country’s reputation and brought the security of the South African passport into question.

Information Regulator establishes enforcement committee The Information Regulator has established an Enforcement Committee to tackle matters related to the Protection of Personal Information Act (POPIA) and the Promotion of Access to Information Act (PAIA). The Enforcement Committee, chaired by Advocate Helen Fourie, with Simonè Margadie as alternative chairperson, comprises 14 independent experts from a wide array of professional backgrounds such as law, information security, education, finance accounting, auditing, actuarial science, forensics and criminal investigations.
